Kasada.lk – Terms and Conditions

Welcome to kasada.lk (“Kasada,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, mobile pages, and any related services (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Site.

 

1. Eligibility

  • You must be 18 years or older to create an account or post ads.
     
  • By using the Site, you represent and warrant that you meet this age requirement and that all information you provide is truthful and up to date.
     

2. Account Registration & Security

  1. Accuracy of Data – You agree to provide accurate, current, and complete information during registration and to keep it updated.
     
  2. Social Login – If you sign in with Google or Facebook, you authorise us to access basic profile details as described in our Privacy Policy.
     
  3. Credentials – You are solely responsible for maintaining the confidentiality of your password (or social-login credentials) and for all activity that occurs under your account.
     
  4. Account Misuse – We may suspend or terminate accounts that:
    • Provide false information,
    • Violate these Terms or any applicable law,
    • Are used for spam, fraud, or harassment.
       

3. Acceptable Use

While using Kasada, you agree not to:

  • Post content that is unlawful, defamatory, obscene, discriminatory, or otherwise objectionable.
  • Impersonate any person or entity.
  • Upload viruses, malware, or other harmful code.
  • Attempt to gain unauthorised access to other accounts or our backend systems.
  • Use automated scripts, bots, or scraping tools without written permission.

We reserve the right to remove any content or suspend any account that violates these rules.

 

4. User-Generated Content

  • Ownership – You retain ownership of the ads, photos, and other material (“Content”) you submit.
  • Licence to Kasada – By submitting Content, you grant Kasada a worldwide, non-exclusive, royalty-free licence to host, reproduce, display, and distribute that Content for purposes of operating and promoting the Site.
  • Responsibility – You are solely responsible for the legality and accuracy of your Content.

 

5. Payments, Packages & Refunds

  • Payment Processing – Payments are handled by Stripe and PayPal. We never store your full credit-card or bank details.
  • Package Duration – Each advertising package has a set duration; once it expires, the ad may be unpublished or shown as “expired.”
  • Refunds – Packages are non-refundable once the ad is published, except where required by law. If you believe you were charged in error, contact us within 7 days of the transaction.
     

6. Third-Party Services & Advertising

  1. We use third-party tools such as Google Analytics, Meta Pixel, Microsoft Clarity, Google AdSense, and Google reCAPTCHA. Use of the Site implies acceptance of those services’ own terms and privacy practices.
     
  2. Ads displayed via Google AdSense are provided by Google; we do not endorse specific advertised products or services.
     
  3. Links to external sites are provided for convenience; Kasada is not responsible for their content or availability.
     

7. Intellectual Property

  • Kasada Content – All text, graphics, logos, and code created by or for Kasada are our intellectual property. You may not copy, modify, or distribute our materials without written permission.
     
  • Trademarks – “Kasada.lk” and related marks are trademarks of Kasada.lk (Pvt) Ltd. All other trademarks are the property of their respective owners.

 

8. Termination

  • By You – You may close your account at any time via your profile settings or by emailing us.
     
  • By Us – We may suspend or terminate your account (with or without notice) if you breach these Terms or if we are required to do so by law.
     
  • Effect – Sections that by nature should survive termination (e.g., licences granted, disclaimers, limitations of liability) will continue to apply.

 

9. Disclaimer & Limitation of Liability

  • “As Is” – The Site is provided “as is” and “as available.” We make no warranties (express or implied) regarding accuracy, reliability, or availability.
     
  • No Event Liability – To the fullest extent permitted by law, Kasada and its directors, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site.
     
  • Cap on Direct Damages – If we are found liable, our aggregate liability shall not exceed the total fees you paid to us in the 12 months preceding the claim.

 

10. Indemnification

You agree to defend, indemnify, and hold harmless Kasada.lk (Pvt) Ltd. and its affiliates from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Site,
  • Your Content, or
  • Your breach of these Terms.

 

11. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Sri Lanka.
  • Any dispute shall be submitted to the exclusive jurisdiction of the courts of Sri Lanka.
  • Before filing suit, you agree to attempt an informal resolution by emailing us a concise description of the dispute; we’ll aim to resolve it within 30 days.

 

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes we will post the revised version and update the “Last updated” date. Continued use of the Site constitutes acceptance of the revised Terms.
